RELEASE FROM RESPONSIBILITY AND ASSUMPTION OF THE RISK FOR PARTICIPATING IN THE MAC & CHEESE FESTIVAL
I, the attendee of the Mac & Cheese Festival (the “Festival”), have voluntarily chosen to participate in the Festival and its activities. I acknowledge that the nature of the Festival may expose me to hazards or risks that may result in personal injury, and I understand and appreciate the nature of such hazards and risks. In consideration of my voluntary participation in the Festival, I hereby accept all risk to my (and/or my child’s) health and of my (or my child’s) injury or death that may result from participating in the Festival and I hereby release The Ohio State University (the “Organizer”), and its boards, officers, trustees, employees, contractors, volunteers, sponsors and representatives (the “Releasees”) from any and all liability to me (or my child), my (or my child’s) personal representatives, estate, heirs, next of kin, and assigns for any and all claims and causes of action for loss of or damage to my (or my child’s) property and for any and all illness or injury to my (or my child’s) person, including my (or my child’s) death, that may result from or occur during my participation at the Festival, whether caused by negligence of the Organizer or the Releasees, or from consuming the food or drinks at the Festival, or otherwise. I further agree to indemnify and hold harmless the Organizer and the Releasees from liability for the injury or death of any person(s) and damage to property that may result from my (or my child’s) negligent or intentional act or omission while attending and participating in the Festival. I understand the Organizer does not carry medical insurance for the protection of Festival attendees and participants and understand that I am responsible for providing my own (and/or my child’s) medical insurance and for any medical costs due to personal injury incurred during the Festival.
Food Allergy Disclaimer: The Festival is not an allergen-free festival. The Organizer will not assume any liability for adverse reactions to foods or drinks consumed, or items one may come in contact with while consuming any food or drinks at the Festival.
I HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND IT TO BE A RELEASE OF ALL CLAIMS AND CAUSES OF ACTION FOR MY INJURY OR DAMAGE TO MY PROPERTY (OR MY CHILD’S) THAT OCCURS WHILE PARTICIPATING IN THE DESCRIBED ACTIVITY AND IT OBLIGATES ME TO HOLD HARMLESS THE OHIO STATE UNIVERSITY FOR ANY LIABILITY FOR INJURY OF ANY PERSON AND DAMAGE TO PROPERTY CAUSED BY MY NEGLIGENT OR INTENTIONAL ACT OR OMISSION.
Photography Disclaimer: The Festival has an event photographer who has been authorized to take photos at the Festival, and news media outlets may be present. By attending the Festival, I consent to having my (and/or my child's) photo or video taken by the event photographer or news media outlets. I further consent to use of my likeness in photograph(s) and or video in publications, promotions, and in other media, whether now known or hereafter existing.
All ticket sales are final. If the event is cancelled, a refund will be issued to the original purchaser.
